This AI Disclaimer forms part of your binding agreement with HEX64 InfoSolutions Private Limited. By using any AI-powered feature of the GrowStart AI platform, you confirm that you have read, understood, and accepted all provisions of this Disclaimer. If you do not accept these provisions, you must not use any AI-powered feature of the Platform.

1 PURPOSE AND SCOPE OF THIS DISCLAIMER

1.1.This Artificial Intelligence Disclaimer ("AI Disclaimer" or "Disclaimer") is issued by HEX64 InfoSolutions Private Limited ("the Company"), the operator of the GrowStart AI platform accessible at https://growstart.ai/ ("the Platform"). It is published in addition to, and forms an integral part of, the Terms and Conditions of Service and Privacy Policy.

1.2.This Disclaimer applies to all AI-powered features of the Platform, including:

the AI Content Generator (posts, captions, ad copy);

the GBP Optimizer (Google Business Profile rewriting and keyword suggestions);

the Lead Manager's AI-generated follow-up messages;

the Review Reply Generator;

WhatsApp Campaigns and WhatsApp auto-reply;

the Email Campaign Builder;

AI Call Scripts;

the AI Chat Assistant (24/7 automated customer chat);

the Ask AI in-platform assistant;

the Business Score feature; and

any other feature of the Platform that generates outputs using artificial intelligence or machine learning models, whether currently available or introduced in the future.

1.3.The purpose of this Disclaimer is to ensure that Users understand the fundamental nature and limitations of AI-generated outputs, and to allocate responsibility for the review, verification, and use of such outputs appropriately between the Company and the User.

2 THE NATURE OF ARTIFICIAL INTELLIGENCE

The AI features of this Platform are powered by large language models, including the Claude model developed by Anthropic, PBC. Large language models do not think, reason, verify facts, or exercise professional judgment. They generate outputs by predicting statistically probable sequences of text based on training data. This has significant implications for the reliability and accuracy of every output the Platform produces.

2.1.How AI-Generated Content Is Produced. All AI-generated outputs on the Platform are produced by transmitting the User's input (the "prompt") to a large language model operated by Anthropic, PBC. The model processes this input and generates a probabilistic output based on patterns in its training data. The model does not:

access real-time information about your business, your customers, your industry, or current market conditions (unless explicitly provided by you in the prompt);

verify the accuracy or truthfulness of any statement it generates;

apply professional judgment, legal analysis, or regulatory expertise to its outputs;

assess whether any output is appropriate, lawful, or suitable for the User's specific context;

guarantee that any output is free from factual error, grammatical error, cultural insensitivity, or legal risk.

2.2.AI Hallucination: Large language models are known to generate outputs that are factually incorrect, internally contradictory, or entirely fabricated a phenomenon known as "hallucination". Hallucinations can include:

invented statistics, data, or facts presented with apparent confidence;

references to non-existent products, services, events, or people;

inaccurate pricing, availability, or service descriptions;

incorrect regulatory, legal, or compliance information;

plausible-sounding but false claims about competitors, third parties, or the market.

The User must independently verify all specific facts, claims, statistics, and information contained in any AI-generated output before publishing, sending, or acting upon it. The presence of confident, fluent, well-structured text is not evidence of accuracy.’

2.3.Bias and Inconsistency: AI models may produce outputs that reflect biases present in training data, including cultural, linguistic, gender, or commercial biases. Outputs may also vary significantly between generations the same prompt may produce different outputs at different times. The Company does not warrant the consistency, neutrality, or impartiality of any AI-generated output.

2.4.Regional Language Limitations: The Platform supports content generation in regional Indian languages. AI performance in regional languages may be lower than in English, and the model may produce outputs with linguistic errors, grammatical inaccuracies, or culturally inappropriate phrasing. Users must apply heightened scrutiny when using or publishing regional language outputs.

3 WHAT AI-GENERATED OUTPUT IS NOT

AI-generated output from the GrowStart AI Platform is NOT professional advice of any kind. It is NOT a substitute for the judgment of a qualified professional. It is a marketing assistance tool only.

3.1.Not Legal Advice: No output generated by the Platform constitutes legal advice. AI-generated content, including campaign copy, review replies, call scripts, email content, WhatsApp messages, and business information, may inadvertently contain statements that create legal risk, including but not limited to:

statements that could constitute misrepresentation under the Consumer Protection Act, 2019;

statements that could be construed as defamatory;

statements that infringe the intellectual property rights of third parties;

statements that violate advertising standards, including ASCI guidelines;

statements that create unintended contractual commitments with customers;

statements that admit liability in the context of a review reply.

The User must independently review all AI-generated content for legal risk before publication. Where doubt exists, the User should seek qualified legal advice.

3.2.Not Financial or Business Advice: The Platform's Business Score, GBP Optimizer recommendations, content strategy suggestions, and lead management insights do not constitute financial, investment, or business advisory services. No reliance should be placed on any AI-generated assessment for the purposes of:

making investment or financing decisions;

regulatory or statutory filings;

business valuation;

creditworthiness assessment;

any other commercially significant decision.

3.3.Not Regulatory or Compliance Advice: AI-generated content does not constitute compliance advice under any regulatory framework, including but not limited to:

FSSAI regulations (food businesses);

AYUSH or drug advertising regulations (health businesses);

Real estate advertising regulations (RERA);

Financial product advertising guidelines (SEBI, RBI, IRDAI);

Alcohol, tobacco, or age-restricted product advertising laws;

Any sector-specific advertising or content restriction applicable to the User's business.

The User is solely responsible for ensuring that all AI-generated content complies with sector-specific regulations applicable to their business.

3.4.Not Marketing Guarantee: The Company makes no representation that AI-generated content will achieve any marketing outcome, including increased customer engagement, higher Google Business Profile rankings, increased lead conversion, revenue growth, or any other commercial result. Any metrics referenced on the Platform (including platform-wide averages) are illustrative and do not constitute a guarantee of individual results.

4 THE USER'S VERIFICATION AND OVERSIGHT OBLIGATIONS

The User bears sole and complete responsibility for reviewing, verifying, approving, and taking responsibility for all AI-generated content before it is published, sent, or acted upon. The Company is not responsible for any consequence arising from the User's failure to review AI-generated content.

4.1.Mandatory Pre-Publication Review: Before publishing or using any AI-generated output, the User must:

read the entire output carefully;

verify every specific fact, figure, price, service description, date, and claim independently;

confirm that the tone, language, and content are appropriate for the intended audience;

ensure the content does not contain false, misleading, defamatory, or legally problematic statements;

confirm compliance with all applicable laws, regulations, and platform policies;

confirm that the content is consistent with the User's actual business offerings and current pricing.

4.2.Automated Features: The Platform offers automated features, including GBP auto-post, WhatsApp auto-reply, and the AI Chat Assistant, which operate without real-time human review of each output. Where the User enables any automated feature, the User:

accepts sole and complete responsibility for all content automatically generated and published or transmitted by such feature;

must configure all business information accurately and completely prior to enabling automated features;

must monitor automated outputs on a regular basis at minimum weekly to detect and correct any errors, inaccuracies, or inappropriate content;

must promptly disable any automated feature upon identifying any error, legal risk, or operational concern;

acknowledges that the Company has no obligation to monitor, review, or intercept automated outputs before they are published or transmitted.

4.3.AI Chat Assistant: The AI Chat Assistant operates autonomously, responding to End Customer queries about the User's business in real time. The User specifically acknowledges that:

the AI Chat Assistant may provide inaccurate information about the User's services, pricing, availability, or policies;

End Customers may rely on responses from the AI Chat Assistant when making purchasing decisions;

any liability arising from an End Customer's reliance on an inaccurate AI Chat Assistant response rests with the User as the operator of the chat service;

the User must keep all business information configured in the AI Chat Assistant current and accurate;

the User should include a disclosure in their customer-facing chat interface indicating that the chat assistant is AI-powered.

4.4.Review Reply Generator: Review replies are publicly visible content on Google Business Profile. A poorly reviewed or inaccurate reply can:

create reputational damage;

constitute an admission of liability that may be used in disputes;

make false representations about third-party reviewers;

violate Google's content policies.

The User must read every AI-generated review reply in full before publishing. This Feature should never be used without individual human review of each reply.

5 FEATURE-SPECIFIC GUIDANCE AND USER RESPONSIBILITIES

5.1.The table below sets out feature-specific guidance on the nature of each AI output and the User's corresponding verification and oversight obligations:

6 NO PROFESSIONAL ADVICE

6.1.GrowStart AI is a marketing automation tool. The Platform does not hold any licence, registration, or accreditation to provide legal, financial, medical, regulatory, tax, or professional advisory services of any kind.

6.2.No AI-generated output on the Platform should be construed as:

legal advice from an advocate, solicitor, or legal practitioner;

financial or investment advice from a SEBI-registered advisor;

tax advice from a chartered accountant or tax professional;

medical or health advice;

any other form of regulated professional advice.

6.3.The User should always consult a qualified professional where AI-generated content touches on legal, financial, regulatory, medical, or compliance matters relevant to their business. The convenience and speed of AI generation does not reduce this obligation.

7 THIRD-PARTY AI MODEL - ANTHROPIC AND CLAUDE

The AI capabilities of GrowStart AI are powered by Claude, a large language model developed and operated by Anthropic, PBC, a corporation incorporated in the United States of America. The Company licenses access to Claude through Anthropic's API.

7.1.Dependency on Third-Party Model: The quality, availability, accuracy, and behaviour of all AI-generated outputs on the Platform are dependent on and subject to the performance, policies, and ongoing operation of Anthropic's Claude model. The Company does not control the underlying model, its training data, its inference behaviour, or Anthropic's operational decisions regarding the model.

7.2.Model Updates and Changes: Anthropic may update, retrain, modify, or replace the Claude model at any time. Such changes may alter the nature, style, quality, or behaviour of AI-generated outputs without prior notice. The Company shall not be liable for any change in output quality or behaviour resulting from changes to the underlying AI model.

7.3.Data Transmission to Anthropic: When a User submits a prompt to any AI-powered Feature, the prompt including any business information, customer data, or other content included in the prompt is transmitted to Anthropic's API infrastructure for processing. This involves a cross-border transfer of data to the United States. By using any AI-powered Feature, the User consents to this processing arrangement. Full details are set out in the Privacy Policy.

7.4.Anthropic's Model Policies: Anthropic's usage policies govern the types of content that the Claude model will and will not generate. Certain requests may be declined by the model in accordance with Anthropic's content policies, independent of the Company's instructions. The Company has no control over model refusals.

7.5.No Endorsement by Anthropic: The Company's use of Claude does not constitute an endorsement of GrowStart AI by Anthropic, PBC. Anthropic is a technology provider only.

8 INTELLECTUAL PROPERTY IN AI-GENERATED OUTPUTS

8.1.Ownership: Subject to compliance with the Terms and Conditions, AI-generated outputs produced by the Platform in response to the User's specific prompts may be used by the User for their own business marketing purposes. The Company does not assert copyright ownership over AI-generated outputs that are the direct product of the User's individual prompts.

8.2.No Warranty of Originality or Non-Infringement: The Company does not and cannot warrant that any AI-generated output is:

wholly original and free from similarity to existing copyrighted works;

free from third-party intellectual property claims;

eligible for copyright protection in India or any other jurisdiction;

safe to publish, reproduce, or commercialise without independent clearance.

8.3.User Accepts IP Risk: The User assumes all intellectual property risk associated with the use of AI-generated content. If any AI-generated output is found to infringe the intellectual property rights of a third party, the User is solely responsible for addressing such infringement and indemnifies the Company against all claims arising therefrom, in accordance with the Terms and Conditions.

8.4.Training Data Concern: Large language models are trained on datasets that may include copyrighted works. There is an industry-wide, unresolved legal question regarding the copyright status of AI-generated outputs and whether such outputs can infringe copyright in training data. The User should be aware of this risk and take independent advice where AI-generated content is to be used for significant commercial purposes.

8.5.Prohibition on Competitive Use: The User must not use AI-generated outputs from the Platform to train, fine-tune, develop, or improve competing AI models or competing marketing platforms. Such use is expressly prohibited under the Terms and Conditions.

9 PLATFORM OUTPUTS ARE NOT INDEPENDENTLY VERIFIED

9.1.The Company does not review, moderate, screen, or verify individual AI-generated outputs before they are delivered to the User. The Platform operates at scale, and it is not operationally practicable for the Company to review each AI-generated post, message, script, reply, or campaign before it is presented to the User.

9.2.The User is the last line of defence before AI-generated content reaches the public or the User's customers. The User's review and approval of each output prior to publication or distribution is the primary quality and compliance control in the system.

9.3.The Company reserves the right, but does not assume any obligation, to monitor outputs for systemic issues, harmful patterns, or regulatory compliance concerns at an aggregate level. Detection of a systemic issue at the aggregate level does not relieve the User of their individual responsibility to review each output.

10 RESPONSIBLE USE OF AI FEATURES

GrowStart AI is a powerful tool when used responsibly. The following guidance is provided to help Users get the best results while managing the risks inherent in AI-generated content.

10.1.Best Practices for AI Content Generation

Provide specific, accurate, and detailed prompts the quality of AI output is significantly influenced by the quality and specificity of the input.

Always include your actual business name, correct pricing, and accurate service descriptions in prompts.

Treat AI-generated content as a first draft requiring human editing, not as final publication-ready content.

Maintain a review log of all AI-generated content published on your behalf.

Disable automated features (auto-post, auto-reply) during periods when you cannot actively monitor outputs.

10.2.Best Practices for Automated Features

Configure all business data accurately and completely before enabling GBP auto-post, WhatsApp auto-reply, or the AI Chat Assistant.

Review and update configured business information promptly whenever services, pricing, or hours change.

Monitor auto-generated chat logs and auto-posted content at least weekly.

Set up alert mechanisms to notify you of unusual activity or customer complaints arising from automated responses.

Disable automated features immediately upon identifying any concern with output quality or accuracy.

10.3.Customer Data and Campaigns

Use only customer lists for which you have obtained valid, documented consent to receive commercial communications.

Ensure WhatsApp campaign recipients have opted in to receive commercial messages from your business.

Include an unsubscribe or opt-out mechanism in all email campaigns.

Do not upload sensitive personal data of customers to the Platform unless strictly necessary.

11 LIMITATION OF THE COMPANY'S LIABILITY FOR AI OUTPUTS

11.1.To the maximum extent permitted by applicable Indian law, the Company shall not be liable for any loss, damage, harm, cost, or liability whether direct, indirect, consequential, or otherwise arising from:

any inaccuracy, error, hallucination, bias, or omission in any AI-generated output;

the User's reliance on AI-generated content without independent verification;

any content automatically published through GBP auto-post, WhatsApp auto-reply, or any other automated feature;

any response generated and transmitted by the AI Chat Assistant to an End Customer;

any intellectual property claim arising from the User's use of AI-generated content;

any regulatory, legal, or compliance consequence arising from the User's publication of AI-generated content;

any claim by an End Customer arising from inaccurate information provided by the AI Chat Assistant;

any failure, degradation, or change in the outputs of Anthropic's Claude model;

any business loss, reputational damage, or customer dispute arising from AI-generated content.

11.2.The Company's aggregate liability in respect of all AI-related claims is subject to the limitation of liability provisions set out in Clause 11 of the Terms and Conditions of Service.

11.3.The User's indemnification obligations under Clause 12 of the Terms and Conditions extend in full to all claims arising from the User's use of AI-generated content, the AI Chat Assistant, and all automated features.

12 UPDATES TO THIS DISCLAIMER

12.1.The Company reserves the right to update or amend this AI Disclaimer at any time, including to reflect changes in AI model capabilities, applicable laws, platform features, or regulatory guidance on AI systems.

12.2.Material changes will be notified to Users through the Platform or by email. Continued use of any AI-powered Feature following notification of a change constitutes acceptance of the revised Disclaimer.

12.3.The Company recommends that Users review this Disclaimer periodically, particularly as the Platform introduces new AI-powered features.
